HR5 Policies Governing Freedom of Association

BC Hydro is subject to the provisions of the Canada Labour Code dealing with Basic Freedoms described in Division 1 (R.S., 1985, c. L-2, s. 8; 1999, c. 31, s. 162(E)). Collective Bargaining policies, procedures and programs exist for both unions at BC Hydro: the International Brotherhood of Electrical Workers (IBEW) and Canadian Office & Professional Employees Union (COPE).

Legislation requires that there be no strikes or lockouts until the designation of essential services is made by the BC Labour Relations Board (in adherence to the BC Labour Relations Code). Once designated, the employer and trade union must supply, provide or maintain in full measure those facilities, productions and services and must not restrict or limit a facility production or service so designated. During the course of a strike or lockout BC Hydro may not engage the services of replacement workers to enable services not deemed essential to continue but may utilize exempt staff within those headquarters.
