Proposals Evaluation Status Update and CEAP Application
The purpose of this notice is to provide Proponents who have submitted Proposals in the Clean Power Call with information concerning:
- The status of BC Hydro’s evaluation of the Proposals, including BC Hydro’s assessment of the status of First Nations consultation; and
- BC Hydro’s application for relief from certain requirements of the CEAP.
1. Status Update
In light of recent decisions of the B.C. Court of Appeal, including The Carrier Sekani Tribal Council v. British Columbia Utilities Commission et. al., for Proposals submitted in the Clean Power Call BC Hydro will be assessing the status of First Nations consultations to determine whether adequate consultation has occurred with respect to the proposed sale of power to BC Hydro. Further information may be required from certain Proponents to enable BC Hydro to complete that assessment.Additional information regarding the evolved requirements of BC Hydro’s First Nations consultation assessment will be posted shortly to BC Hydro’s Clean Power Call website. Please be advised that BC Hydro will contact Proponents in respect of any additional information that may be required concerning projects submitted to the Clean Power Call.
With respect to the future timing of the Clean Power Call process, we anticipate that any EPA awards will occur in the Fall of 2009.
2. CEAP Application
Given BC Hydro's ongoing assessment of the status of First Nations consultation in relation to the Clean Power Call, BC Hydro has filed an application with the British Columbia Utilities Commission (BCUC) requesting relief from section 4.10 of British Columbia Transmission Corporation's (BCTC) Competitive Electricity Acquisition Process (CEAP). The requested relief is with respect to the date by which BC Hydro is required to select successful Clean Power Call Proponents and submit an application to BCTC for a corresponding modification of network transmission service. If this application is not submitted to BCTC by the specified deadline, all Interconnection Requests for the Clean Power Call are deemed withdrawn. BC Hydro has requested that the CEAP deadline be extended to December 31, 2009. As per Order G-96-09 issued on August 20, 2009, the BCUC has agreed to this request to extend the CEAP deadline for the Clean Power Call only.

Relief Granted from Certain Requirements of CEAP
Further to the Clean Power Call website update posted on May 28, 2009 regarding BC Hydro’s application to the British Columbia Utilities Commission (BCUC) for relief from certain requirements of British Columbia Transmission Corporation’s (BCTC’s) Competitive Electricity Acquisition Process (CEAP), please be advised that this relief has been granted. The requested relief was with respect to the June 15, 2009 date by which BC Hydro was required to submit an application to BCTC for modification of network transmission services.As per BCUC Order G-63-09 issued on June 1, 2009, for the Clean Power Call only, BC Hydro shall submit an application to BCTC, nominating the successful projects as network resources as required by Section 4.10 of the CEAP Procedures, within four weeks following the date of the BCUC’s decision on the 2008 Long Term Acquisition Plan.

Application for Relief from Certain Requirements of CEAP
In the Clean Power Call website update dated December 23, 2008, BC Hydro stated that it intends to award Electricity Purchase Agreements, to the extent that any Proposals provide cost-effective energy supply, following the receipt of the British Columbia Utilities Commission (BCUC) decision regarding the 2008 Long Term Acquisition Plan (LTAP).Given the uncertainty around the LTAP decision date, BC Hydro has filed an application with the BCUC requesting relief from section 4.10 of British Columbia Transmission Corporation's Competitive Electricity Acquisition Process (CEAP). The requested relief is with respect to the date by which BC Hydro is required to select successful Clean Power Call Proponents and submit an application to BCTC for a corresponding modification for network transmission service. If this application is not submitted to BCTC by the specified deadline, all Interconnection Requests for the Clean Power Call are deemed withdrawn. BC Hydro is requesting that the CEAP deadline be extended from June 15, 2009 to 4 weeks after the BCUC's LTAP decision.

2008 Long Term Acquisition Plan (LTAP)
BC Hydro has filed a letter [PDF, 211 Kb] with the British Columbia Utilities Commission (BCUC) relating to the 2008 Long Term Acquisition Plan. The letter references the target volume for the Clean Power Call.

Long Term Acquisition Plan (LTAP) Evidentiary Update
Please be advised that on December 22, 2008 BC Hydro filed with the British Columbia Utilities Commission (BCUC) an Evidentiary Update to the 2008 LTAP [PDF, 2.0 Mb] to address recent economic events and the resulting impacts on BC Hydro's load forecast and Demand Side Management Plan. In addition, this filing updates the key items that impact BC Hydro commitments to resource acquisition activities, including expected results of the Bioenergy Call Phase I RFP and current attrition estimates for the F2006 CFT.Given the reduced energy load/resource gap arising from the LTAP Evidentiary Update, BC Hydro has reduced the target size of the Clean Power Call from 5,000 GWh/year to 3,000 GWh/year. Accordingly the revised Order being sought by BC Hydro requests that the BCUC endorse: "The proposed Clean Power Call pre-attrition target of 3,000 gigawatt hours per year of firm energy".
The RFP, when issued, indicated in section 1 a target of 5,000 GWh/year of seasonally and/or hourly Firm Energy, and further indicated that the target may be revised during the RFP process. Evaluation criteria in section 18 of the RFP include consideration of BC Hydro's load/resource balance at the time of evaluation. The LTAP filing is referenced in section 19 of the RFP. BC Hydro intends to continue with the RFP process as per the current RFP schedule and, to the extent that any Proposals provide cost-effective energy supply, BC Hydro intends to award Electricity Purchase Agreements following the receipt of the BCUC decision regarding the 2008 LTAP.

Confidentiality and Compliance Provisions
As BC Hydro continues with the evaluation phase of the Clean Power Call, we wish to remind all Proponents that they remain bound by the Confidentiality and Compliance Agreement, including section 20 of the RFP. Among other things, section 20.7 of the RFP prohibits collusion and discussions among Proponents concerning their respective Proposals. Accordingly, all Proponents should refrain from (i) disclosing their Proposals to any other Proponent and (ii) accessing the Proposals of other Proponents, in each case for any reason. Proponents should note that violations of section 20 of the RFP may result in serious consequences, including but not necessarily limited to, disqualification.
