BC Hydro is required by law to report to the regulatory agencies (e.g. Provincial Ministry of Environment, Environment Canada, Fisheries and Oceans) the environmental incidents that fall into the agencies' reporting requirements.

BC Hydro was issued a warning letter from Environment Canada under the Canadian Environmental Protection Act for failure to report a PCB spill which occurred at Ness Lake near Prince George in December 2008. BC Hydro has responded with a letter, to go on the record, asserting that the warning letter was not appropriate given the circumstances outlined.

The warning letter indicates the agency believes an offence has occurred but will not be prosecuting. The letter goes on record to guide the agency’s future incident responses.
