The Environmental Regulatory Incidents measure is defined as the number of externally reportable, preventable environmental incidents.

Results for the fiscal 2008 Environmental Regulatory Compliance measure are worse than target as a result of 39 incidents compared to the target of 15 incidents. None of these incidents was considered severe. A total of 27 incidents are believed to be the result of human error; five of which were related to Water Licence violations and four violations of approved work practices for riparian vegetation. Nine incidents were the result of equipment failure. For the remaining three incidents the direct cause could not be determined. An improved measure will be used in fiscal 2009 that will include the consequence of each incident.
